According to Peel Regional Police, a Mississauga man who allegedly struck a pedestrian and then left the scene has been charged with failing to remain on the scene of an accident causing death. The driver reportedly left the scene of the auto-pedestrian accident without making any attempt to offer aid to the seriously injured man. The pedestrian was rushed to a local hospital, where he later succumbed to his injuries. The fatal accident occurred around 6:30 p.m. at the intersection of Morning Star Drive and Goreway Drive in Malton on Jan. 11.
Police were able to locate the 20-year-old driver with the help of the community, members of which provided multiple tips regarding the damaged car. Workers in auto repair shops were also asked by police to be on the lookout for the damaged vehicle. The victim’s wife expressed gratitude that the driver had been taken into custody but expressed her shock and grief at the loss of her husband.
The deceased pedestrian, an 82-year-old Korean military veteran who had been a decorated officer, was crossing Goreway Drive when he was hit. According to his wife, he made sure to keep in shape and enjoyed spending time with friends at the Malton Community Centre playing ping pong.
When a pedestrian is killed by a negligent or careless driver, the pedestrian’s family may have the option of filing a wrongful death lawsuit. In addition to compensatory damages, which are intended to pay for accident-related expenses, the family may also seek punitive damages. Also known as exemplary damages, punitive damages are additional financial penalties paid to the plaintiffs. The intent of such damages is to punish a reckless driver for his or her behaviour.
